Terms and Conditions

REAL ESTATE AGENCY, VILMAR NEKRETNINE L.T.D. (hereinafter referred to as: Vilmar) is an authorized  company that meets the requirements according to the law of property mediations for mediation in real estate transactions, and is registered in the Register of Mediators (registration number 47/2022) at the Croatian Chamber of Commerce.
Vilmar is an agency specialized in mediation in the rental of houses and apartments, the leasing of business premises in Zagreb, and the purchase and sale of real estate.

The general terms and conditions of Vilmar's business govern the business relationship with a private or legal entity who gives Vilmar an order or enters into an agreement on mediation. The general conditions are an integral part of the mediation agreement, and by concluding the mediation agreement, the principal confirms that he is familiar with and agrees with the provisions of the mediator's business conditions.

A private or legal entity who gives Vilmar a mediation order enters into a mediation agreement with Vilmar Nekretnine:

- when the lessor/lessor asks Vilmar to put him in touch with a lessee who would negotiate with him on the conclusion of a real estate lease contract or to mediate in finding a suitable lessee for his real estate
- when the lessee asks Vilmar to put him in touch with the landlord/lessor of real estate or to mediate in finding a suitable property for rent/lease, Vilmar's obligations are:
- to inspect documents proving ownership or other legal rights to the property in question
-present the real estate in question
- conduct the negotiations necessary to reach an agreement for the rent/lease of the property in question in good faith
- obtain a proposal for a rental/lease agreement
- to attend the handover of the real estate, during which the minutes of the handover are drawn up

The brokerage fee is paid after the signing of the rental/lease agreement and the purchase agreement (in the case of signing a pre-contract, 1/2 of the brokerage fee is paid after signing the pre-contract, and the remaining 1/2 after signing the main sales contract).

RENTING AND LEASING - the commission from the lessor is expressed as a percentage of one month's rent.
75% for rent or lease duration from 1 to 8 months
100% for rent or lease duration from 9 to 48 months
150 % for rent or lease duration of 49 months and more

The aforementioned fee represents half of the total commission, while the other half of the commission is exclusively payable by the lessor/lessor of the real estate.

SALE
commission for the real estate seller for mediating the sale:
1-3% of the final purchase price; but not less than €1,000.00; which amount represents half of the total commission, while the other half of the commission is exclusively recoverable from the real estate buyer.

BUYING
commission for the buyer of real estate for mediation of the purchase price:

1-3% of the final purchase price; but not less than €1,000.00; which amount represents half of the total commission, while the other half of the commission is exclusively recoverable from the seller of the property.

EXCHANGE OF REAL ESTATE
When exchanging real estate, a commission is charged from each contractual party in the exchange, and a percentage is calculated from the final agreed value of the real estate, which the party acquired through the exchange in the amount of 1 - 3% of the final agreed value of the real estate, for each contractual party.
